Michigan Chamber of Commerce Member - ELECTRONIC ACCESS AGREEMENT
THIS ELECTRONIC ACCESS AGREEMENT, "Agreement" is made this the ____ day of _______, 200__, by and between Laborchex, Inc., a Mississippi Corporation, Affiliates and Subsidiaries, hereinafter referred to collectively as "Corporation", ___________________________, Affiliates and Subsidiaries, hereinafter referred to as "Client" and ___________________________, hereinafter referred to as "End User". In consideration of the terms and conditions herein contained, the parties hereto agree as follows:
Client hereby authorizes End User to electronically submit background investigation requests to Corporation on behalf of Client. End User agrees that, prior to submission, that End User shall have in their possession a release, approved by LABORCHEX and signed by the Applicant, that grants the Applicant’s permission to perform an investigation into his/her background for employment purposes. End User understands that submitting a background investigation request without a signed release from the applicant is a violation of federal law that can result in irreparable damages to both CLIENT and LABORCHEX.
End User agrees not to sell, disseminate, or otherwise distribute in whole or in part, any information provided by LABORCHEX to any third party. End User will order, receive and use information provided by LABORCHEX solely for employment purposes, and shall not request or use information obtained from LABORCHEX for purposes not permitted by law. The laws and regulations governing fair practices include, but are not limited to, the Fair Credit Reporting Act (FCRA) and its states’ analogues and statutes; the Americans with Disabilities Act (ADA) and its states’ analogues and statutes; and the Drivers Privacy Protection Act (DPPA) and its states’ analogues and statutes.
End User agrees to authorize LABORCHEX to create electronic documents to be retained on file by LABORCHEX, that summarize the above statements and End Users agreement and adherence to them by End Users electronic signature. End User further authorizes that End Users electronic signature may be used as a substitute for End Users actual signature that is now on file with LABORCHEX.
End User warrants that he/she has read and fully understands the terms of the Agreement and agrees to abide by said terms. End User understands that failure to do so may result in penalties of perjury and fines, and disciplinary action up to and including termination of employment.
IN WITNESS THEREOF, the parties hereto have caused this Agreement to be duly executed as of the date first written.
